Please read Maximo Nivel’s Terms & Conditions below prior to submitting your online registration.
Maximo Nivel reserves the right to change these Terms and Conditions and its services and programs at any time without notice.
Maximo Nivel reserves the right to refuse acceptance of any application or participant.
10-Year Payment Guarantee
1. 10-Year Payment Guarantee. If you make a deposit, installment payment(s), or pay your program fees in full, but then you cannot travel on the planned dates, Maximo Nivel’s 10-Year Payment Guarantee means you can apply your payment to future programs for 10 years! Your payment can be applied to Volunteer Abroad, International Internship, TEFL Certification, Spanish Immersion, Gap Year, and Study Abroad programs. Your payment is fully transferrable, so a family member or friend can apply the value of your payment to their own program instead.
2. Program fees are non-refundable, however if you must cancel your program for any reason, Maximo Nivel issues a Credit Letter equal to 100% of what you have paid. Your Credit Letter is valid towards Volunteer Abroad, International Internship, TEFL Certification, Spanish Immersion, Gap Year, and Study Abroad programs. Your Credit Letter is valid for 10 years and is fully transferable.
3. If you begin your program, but you must return home before your program end date, Maximo Nivel provides you with a Credit Letter pro-rated from your last day in the program. Your Credit Letter is valid towards Volunteer Abroad, International Internship, TEFL Certification, Spanish Immersion, Gap Year, and Study Abroad programs. Your Credit Letter is valid for 10 years and is fully transferable.
Travel
The participant is responsible for arranging and paying for his/her travel to the destination country. This includes airfare and/or other transportation costs to and from the destination country as well as all local transportation costs.
It is the participant’s responsibility to carry the necessary documents when traveling internationally (e.g. valid passport). Maximo Nivel may advise the participant on required travel documents, but Maximo Nivel is not responsible for ensuring the participant’s travel documents are in proper order to travel. Participants are solely responsible for ensuring their travel documents are up to date and valid for their planned travel.
Insurance
Maximo Nivel does not provide participants with insurance of any kind. Travel insurance is strongly recommended for each participant and participants should purchase this prior to departing on their trip. The participant is responsible for evaluating and determining the kind of insurance coverage he/she should have.
Personal Risk
The participant acknowledges and accepts the responsibilities and risks that international travel, international work/study, and international volunteer programs include. These risks increase because Maximo Nivel’s programs take place in developing countries. The participant fully and solely accepts these risks as an inherent part of their planned travel.
The participant assumes all liability and responsibility for any eventuality that may occur, including personal injury, emotional distress, death, and/or loss or damage to personal property. Furthermore, the participant agrees to hold harmless Maximo Nivel, its partners, its management, and its employees. The participant also agrees NOT to make any type of claim, financial or otherwise, against any of the aforementioned parties.
Maximo Nivel reserves the right to remove any person from any program or activity if that person’s actions or behavior impede the operation of the program or infringe on the rights, welfare, and enjoyment of other participants. Anyone removed from a program will NOT be entitled to a refund or discount.
Field Conditions
The participant acknowledges Volunteer and Internship placements may change unexpectedly and without prior notice. Furthermore, tours, treks, and other events are subject to change due to varying field conditions. Maximo Nivel reserves the right to make changes and adjustments to its programs and itineraries at its sole discretion to ensure program optimization and participant safety.
Class Scheduling
Group classes may be subject to availability based on demand. In the event there are not enough people to form group classes at specific levels, class time may be adjusted as follows:
– 4 hours of group class may move to 2 hours of private class
– 2 hours of group class may move to 1 hour of private class
Website As-Is
The Maximo Nivel website exists for the sole purpose of promoting Maximo Nivel’s services. This website is operated by Maximo Nivel from its offices in Costa Rica, Guatemala, and Peru. Maximo Nivel makes no guarantee or implied warranty that the information and materials contained in this website are error-free. No liability is assumed for errors, omissions, or damages resulting from the use of the information contained herein. The information provided is on an “as is” basis.
Rules & Safety Regulations
The participant agrees to abide by all rules and regulations as stipulated by Maximo Nivel, its employees, project sites, and housing partners. The participant agrees to comply with Maximo Nivel’s codes of conduct and safety waiver.
The participant agrees to abide by all local laws, as well as all rules stipulated by Maximo Nivel and its employees and partners, with respect to alcohol consumption.
Whereas Maximo Nivel may provide basic information about local laws, Maximo Nivel is NOT a legal expert and it is the participant’s sole responsibility to ensure he/she is in compliance with the law.
Use of illegal drugs is strictly prohibited and will result in immediate dismissal from the program with no refund.
Maximo Nivel reserves the right to notify the participant’s emergency contact if the volunteer is dismissed from the program, and in all other circumstances as solely deemed appropriate by Maximo Nivel.
Feedback & Photos
Maximo Nivel reserves the right to use any feedback, comments, photos, and other images provided by the participant or captured by Maximo Nivel.
Force Majeure
Maximo Nivel assumes no liability or responsibility for any lack of performance or failure of its services or programs where that failure arises from any cause reasonably beyond Maximo Nivel’s control.
Indemnification
The participant agrees to indemnify Maximo Nivel against any and all liability arising directly or indirectly from traveling, living, and/or working internationally. Furthermore, the participant agrees NOT to hold Maximo Nivel liable for any actions or omissions of any of its partner organizations.
To the full extent permissible at law, all representations, terms, warranties, guarantees, or conditions whether implied by statute, common law or custom of the trade or otherwise, including, but not limited to, implied warranties and guarantees, are excluded.
Notwithstanding this or any other agreement, Maximo Nivel’s liability shall not in aggregate exceed the amount of the program fee paid by the participant.
Governing Law
These terms and conditions and Maximo Nivel’s programs are governed by the applicable laws of Costa Rica, Guatemala, or Peru, as determined by the participant’s destination country.
